General Terms and Conditions
1. Scope
The following terms and conditions apply to all orders placed through our online shop by consumers and entrepreneurs.
For Germany, the following applies: Consumers are, according to § 13 BGB, any natural person who enters into a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their independent professional activity.
For Austria, the following conditions apply: "Consumer" is to be understood as the "consumer" within the meaning of the Consumer Protection Act (KSchG).
For Switzerland, the following conditions apply: In the following terms, "consumer" is to be understood as the "consumer" under Swiss law.
The following applies to entrepreneurs: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby objected to; they will only become part of the contract if we have expressly agreed to them.
2. Contracting parties, conclusion of contract, correction options
The purchase contract is concluded with Cognisance UG.
By listing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the products contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by email.

The contract text is not stored by us.
4. Delivery Conditions
4.1 Shipping costs
In addition to the listed product prices, shipping costs will be added for standard shipping in the amount of
- 4.99 euros (Germany) as well as 14.99 euros (Austria) for customers based in Germany or Austria
- 20 CHF CHF for customers based in Switzerland
4.2 Delivery Options
Delivery options
We ship the products to the delivery address provided during the ordering process.
We only deliver by shipping. Unfortunately, self-pickup of the goods is not possible.
5. Payment
5.1 Prices
The prices specified at the time of order apply. These are total prices and include the statutory value-added tax.
5.2 Due Date and Payment Default
The price is due upon conclusion of the contract, unless a later date results from the following payment terms.
For customers based in Germany and Austria:

To consumers: In the event of a payment default, we reserve the right to charge you a fee of 1.50 euros per reminder for the second and each subsequent reminder. You retain the right to prove that a lesser damage has occurred. Further claims remain unaffected by this.

To entrepreneurs: In the event of a payment default, we reserve the right to charge you the statutory default interest at a rate of nine percentage points above the base interest rate, as well as a flat fee of 40 euros. Further claims remain unaffected.
For customers based in Switzerland:

To consumers: In the event of a payment default, we reserve the right to charge you a fee of 1.50 CHF per reminder for the second and each subsequent reminder. You retain the right to prove that a lesser damage has occurred. Further claims remain unaffected by this.
- To the entrepreneur: In the event of a payment default, we reserve the right to charge you default interest at a rate of nine percentage points above the ECB base rate, as well as a flat fee of 40 CHF. Further claims remain unaffected.
5.3 Payment Methods
In our shop, the following payment methods are generally available to you.
Prepayment
When selecting the payment method advance payment, we will provide you with our bank details in a separate email and deliver the goods after receipt of payment.
Credit card
In the ordering process, you enter your credit card details.
Your card will be charged immediately after placing the order.
SEPA direct debit procedure
By placing the order, you grant us a SEPA direct debit mandate. We will inform you of the date of the account debit at least one banking day in advance (so-called prenotification). A banking day is any weekday except Saturdays, nationwide public holidays, as well as December 24 and 31 of each year.
The account will be debited before the goods are shipped.
PayPal, PayPal Express
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your login credentials, and confirm the payment instruction.
The payment transaction is carried out by PayPal immediately after placing the order. Further information is provided during the ordering process.
PayPal can offer additional payment methods in the customer account to registered and selectively chosen PayPal customers according to its own criteria. However, we have no influence on the offering of these methods; further individually offered payment methods concern your legal relationship with PayPal. PayPal Plus
In cooperation with the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), we offer you the following payment options as PayPal Services. Unless otherwise specified below, payment via PayPal does not require registration with PayPal. Further information is available with the respective payment option and during the ordering process.
PayPal, PayPal Express
To pay the invoice amount using the PayPal payment option, you must be registered with PayPal, authenticate yourself with your login credentials, and confirm the payment instruction.
The payment transaction is carried out by PayPal immediately after placing the order.
PayPal can offer additional payment methods in the customer account to registered and selectively chosen PayPal customers according to its own criteria. However, we have no influence on the offering of these methods; further individually offered payment methods concern your legal relationship with PayPal. Credit card via PayPal
Your card will be charged by PayPal after the goods have been shipped.
Direct debit via PayPal
Payment by direct debit via PayPal requires an address and credit check and is made directly to PayPal. By confirming the payment instruction, you grant PayPal a direct debit mandate. You will be informed by PayPal about the date of the account debit (so-called prenotification). The account debit takes place before the shipment of the goods.
Sofort by Klarna
To pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have a bank account enabled for online banking, identify yourself accordingly, and confirm the payment instruction. Your account will be charged immediately after placing the order. Further information is provided during the ordering process.
Google Pay
To pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have activated the Google Pay function, authenticate yourself with your login credentials, and confirm the payment instruction. The payment transaction will be carried out immediately after placing the order. Further information is provided during the ordering process.
Apple Pay
To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the browser "Safari", be registered with Apple, have activated the Apple Pay function, authenticate yourself with your login credentials, and confirm the payment instruction. The payment transaction will be carried out immediately after placing the order. Further information is provided during the ordering process.
giropay
In cooperation with the payment service provider paydirekt GmbH, Stephanstr. 14-16, 60313 Frankfurt a. M, we offer the payment method giropay. To be able to pay the invoice amount via giropay, you must have a bank account enabled for online banking, identify yourself accordingly, and confirm the payment instruction. Your account will be charged immediately after placing the order. Further information is provided during the ordering process.
Giropay can offer registered and selectively chosen giropay customers additional payment options in their customer account. However, we have no influence on the offering of these options; any further individually offered payment options concern your legal relationship with giropay. paydirekt
In cooperation with the payment service provider paydirekt GmbH, Stephanstr. 14-16, 60313 Frankfurt a. M, we offer the payment method paydirekt. To be able to pay the invoice amount via paydirekt, you must have a bank account enabled for online banking, identify yourself accordingly, and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. Further information is provided during the ordering process.
Paydirekt can offer registered and selectively chosen paydirekt customers additional payment methods in their customer account. However, we have no influence on the offering of these methods; further individually offered payment methods concern your legal relationship with paydirekt. Amazon Pay
To pay the invoice amount via the payment service provider Amazon Payments Europe S.C.A. 38 avenue J.F. Kennedy, L-1855 Luxembourg ("Amazon"), you must be registered with Amazon, authenticate yourself with your login credentials, and confirm the payment instruction. The payment transaction will be carried out by Amazon Pay within one banking business day after placing the order.
Amazon Pay can offer registered and selectively chosen Amazon Pay customers additional payment methods in their customer account. However, we have no influence on the offering of these methods; further individually offered payment methods concern your legal relationship with Amazon Pay. Klarna
In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer you the following payment options. Payment via Klarna is only available to consumers. Unless otherwise specified below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. Further information is provided with the respective payment option and in the ordering process.
Purchase on account via Klarna
The invoice amount is due 14 days after the shipment of the goods and receipt of the invoice.
Klarna can offer registered and selected Klarna customers additional payment options in their customer account according to its own criteria. However, we have no influence on the offering of these options; further individually offered payment options concern your legal relationship with Klarna. For more information, please refer to your Klarna account.
Installment purchase via Klarna
You can pay the invoice amount in monthly installments of at least 1/24 of the total amount. The minimum installment amount is 6.95 euros.
Klarna can offer registered and selected Klarna customers additional payment options in their customer account (e.g., interest-free installment plans). However, we have no influence on the offering of these options; further individually offered payment options concern your legal relationship with Klarna. Klarna Credit Card
In the ordering process, you enter your credit card details. Your card will be charged by Klarna immediately after placing the order. No address or credit check will be conducted.
Klarna Direct Debit
You grant Klarna a SEPA direct debit mandate. Klarna will inform you about the date of the account debit (so-called prenotification). The account debit will occur after the shipment of the goods.
6. Right of withdrawal
You have the statutory right of withdrawal as described in the withdrawal instructions.
7. Retention of title
The product remains our property until full payment is made.
For customers based in Switzerland, we are entitled to make a corresponding entry in the retention of title register.
For entrepreneurs, the following applies additionally: We retain ownership of the product until all claims from an ongoing business relationship have been fully settled. You are allowed to resell the reserved goods in the ordinary course of business; all claims arising from this resale are assigned by you to us in advance up to the amount of the invoice, regardless of any connection or mixing of the reserved goods with a new item, and we accept this assignment. You remain authorized to collect the claims, but we may also collect the claims ourselves if you do not meet your payment obligations. We will release the securities due to us at your request to the extent that the realizable value of the securities exceeds the value of the outstanding claims by more than 10%.
8. Transport damages
For consumers: If goods are delivered with obvious transport damage, please report such defects to the carrier as soon as possible and contact us immediately. Failure to report or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us to assert our own claims against the carrier or the transport insurance.
For entrepreneurs, the risk of accidental loss and accidental deterioration passes to you as soon as we have delivered the item to the carrier, the freight forwarder, or the person or institution otherwise designated to carry out the shipment.
9. Warranty and Guarantees
9.1 Warranty Law
For consumers based in Germany and Austria, the following applies:

You are to examine the condition of the received item as soon as it is feasible according to usual business practice and, if defects appear for which the seller is liable, immediately notify the seller. If the consumer fails to do this, the purchased item is considered approved, except for defects that were not detectable during proper inspection. If such defects appear later, notification must be made immediately after discovery; otherwise, the item is also considered approved with respect to these defects.
Send the defective product back to us with a description of the defect. You bear the transport costs incurred. We provide warranty by remedying defects. This is done at our discretion either by eliminating the defect (repair) or by delivering a defect-free item (replacement delivery). If the subsequent performance fails, you are entitled to withdraw from the contract. This does not apply in the case of insignificant defects. A right to a price reduction is excluded.
Towards entrepreneurs and among merchants, the following applies:
Unless expressly agreed otherwise below, the statutory warranty law applies.
The following limitations and shortened deadlines do not apply to claims for damages caused by us, our legal representatives, or vicarious agents.
• in case of injury to life, body, or health
• in case of intentional or grossly negligent breach of duty as well as fraud
• in case of breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance the contracting party can regularly rely (cardinal obligations)
• within the scope of a warranty promise, as agreed, or
• as far as the scope of the Product Liability Act is applicable.
Restrictions on entrepreneurs
For entrepreneurs, only our own specifications and the product descriptions of the manufacturer that have been incorporated into the contract are considered as agreements regarding the quality of the goods; we assume no liability for public statements made by the manufacturer or other advertising claims. For entrepreneurs, the limitation period for claims for defects in newly manufactured goods is one year from the transfer of risk. The previous sentence does not apply to goods that have been used in accordance with their usual manner of use for a building and have caused its defectiveness. The sale of used goods is made excluding any warranty. The statutory limitation periods for the recourse claim under § 445a BGB remain unaffected.
Notice to merchants
Among merchants, the inspection and notification obligation regulated in § 377 HGB applies. If you fail to give the notification regulated there, the goods are deemed approved, unless it is a defect that was not recognizable during the inspection. This does not apply if we have fraudulently concealed a defect.
9.2 Warranties and Customer Service
Information about any additional warranties that may apply and their exact conditions can be found for each product and on special information pages in the online shop.
10. Liability
For claims arising from damages caused by us, our legal representatives, or vicarious agents, we are always fully liable.
- in case of injury to life, body, or health,
- in case of intentional or grossly negligent breach of duty,
- in case of warranty promises, as agreed, or
- as far as the scope of application of the Product Liability Act is opened.
In the event of a breach of essential contractual obligations, the fulfillment of which is necessary for the proper execution of the contract and on which the contracting party can regularly rely (cardinal obligations), caused by slight negligence on our part, our legal representatives, or vicarious agents, liability is limited in amount to the foreseeable damage at the time of contract conclusion, which typically must be expected to occur.
Claims for damages are excluded, by the way.

13. Final Provisions
If you are an entrepreneur, German law applies to the exclusion of the UN Sales Convention.
If individual clauses of these terms and conditions are wholly or partially invalid, the contract remains valid in all other respects. To the extent that individual clauses are invalid, the content of the contract shall be governed by statutory provisions.
